Please read carefully. These Terms include a binding arbitration clause (Section 17), a class action waiver (Section 17.3), limitations on our liability (Section 15), and a strict 18+ age requirement. By using Zetta, you agree to these Terms in full.
These Terms of Service ("Terms") constitute a legally binding agreement between you and Zetta ("we," "our," or "us") governing your access to and use of the Zetta insect growth documentation application and all related features and services (collectively, the "Service"). By registering for or using the Service, you confirm that you have read, understood, and agreed to be bound by these Terms in their entirety. If you do not agree, you must not use the Service.
I
Acceptance of Terms
1.1 — Binding Agreement

By downloading, installing, registering for, or using any part of the Service, you enter into a legally binding contract with Zetta effective as of the date of your first access. If you are accepting on behalf of a legal entity, you represent that you have authority to bind that entity.

1.2 — Incorporated Documents

These Terms incorporate by reference our Privacy Policy, Community Guidelines, and any other policies we publish within the Service. In any conflict, these Terms shall prevail unless a supplementary policy expressly governs a specific subject matter.

1.3 — Language

These Terms are drafted in English, which is the controlling language. Any translation is for convenience only; in any inconsistency, the English version governs.

II
Eligibility & Account Registration
2.1 — Age Requirement

The Service is available exclusively to individuals who are 18 years of age or older. By registering, you represent and warrant that you are at least 18. We reserve the right to immediately terminate any account where we have reasonable grounds to believe the holder is under 18, without prior notice or liability.

2.2 — Accurate Registration

You agree to provide truthful, current, and complete registration information, including your real date of birth. Providing false information to circumvent the age restriction is a material breach of these Terms and grounds for immediate permanent account termination.

2.3 — One Account Per User

Each individual may maintain only one active Zetta account. Creating duplicate accounts to evade bans, suspensions, or enforcement actions is prohibited and may result in permanent termination of all associated accounts.

2.4 — Third-Party Sign-In

You may register via Apple Sign-In or Google. By doing so, you authorize Zetta to receive limited profile information from those providers as permitted by your consent settings, subject to their respective terms and privacy policies.

2.5 — Geographic Availability

The Service may not be available or fully functional in all jurisdictions. You are responsible for ensuring your use complies with the laws of your country of residence.

III
Account Security & Responsibility
3.1 — Credential Security

You are solely responsible for maintaining the confidentiality of your account credentials. Do not share your password with any third party. Zetta will never request your password through any communication channel.

3.2 — Unauthorized Use

Notify us promptly at service@zettas.net if you suspect unauthorized use of your account. To the fullest extent permitted by law, Zetta is not liable for losses arising from unauthorized use prior to your notification.

3.3 — Account Responsibility

You are fully responsible for all activity occurring through your account, including all observation records created, photos uploaded, community content published, and purchases made, whether or not personally initiated by you.

IV
The Service
4.1 — What Zetta Offers

Zetta is an insect lifecycle documentation platform providing:

  • A personal observation journal for manually recording insect sightings, growth stages, and behavioral notes
  • Photo upload capabilities to document each developmental stage with one or multiple photos per observation
  • Growth timeline linking to connect observations of the same specimen across time
  • Flexible location tagging with privacy controls (exact, approximate, or hidden)
  • Optional community features for sharing observations with other naturalists
  • Data export tools allowing you to download your complete field journal
  • In-app purchasing for premium storage and advanced journal features
4.2 — Service Availability

We strive for continuous availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, infrastructure issues, or events beyond our reasonable control.

4.3 — Service Evolution

Zetta is continuously developed. We may add, modify, or discontinue features at any time. We will provide reasonable advance notice of material changes affecting your use of the Service.

V
Observation Journal Features
5.1 — Your Journal, Your Data

Your observation records, growth timelines, field notes, and uploaded photos constitute your personal field journal on Zetta. This data belongs to you. We store and maintain it on your behalf solely to deliver the journaling experience. You may export your complete journal at any time from Settings > Data > Export Journal.

We strongly encourage regular journal exports as a backup practice. Deleted records cannot be recovered after the deletion period has elapsed.
5.2 — Photo Uploads

You may upload photos to each observation record to document the physical appearance of an insect at a given stage. By uploading photos, you represent and warrant that you have the right to use and share these images. Photos must depict actual insect specimens relevant to your observation record. Uploading deceptive, fabricated, or unrelated imagery as observation photos is prohibited.

5.3 — Observation Accuracy

Zetta is a personal journaling and documentation tool, not a scientific database. You are responsible for the accuracy of the information you record. Zetta does not verify species identifications or observation data submitted by users. Community species information should not be relied upon as authoritative scientific data without independent verification. See Section 13 (Scientific Disclaimer) for full details.

5.4 — Visibility Controls

Each observation can be set to Private (visible only to you) or Public (visible in the community feed). The default visibility of new observations is configurable in account settings. You may change visibility at any time from the record settings. When making observations public, you acknowledge that the content (subject to EXIF location stripping) will be visible to other Zetta users.

5.5 — Data Continuity

We take reasonable steps to maintain the availability and integrity of your stored observation data. However, we do not guarantee that data will never be lost due to technical failures. We encourage all users to export and back up their observation journals regularly.

VI
User-Generated Content
6.1 — Your Responsibility

You are solely responsible for all content you submit to the Service, including observation records, photos, field notes, species descriptions, and community comments. By submitting content, you represent and warrant that you own or have all necessary rights to it and that it complies with these Terms and all applicable laws.

6.2 — License Grant

By publishing UGC publicly, you grant Zetta a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, and distribute your content within the Service and in connection with promoting Zetta, subject to your visibility settings. You retain ownership of all original content you create. This license does not include the right to sell your content to third parties for their independent commercial use.

6.3 — No Endorsement

Publication of UGC on Zetta does not constitute our endorsement, verification, or scientific validation of that content. Species identifications and ecological observations shared by users represent personal observations and are not peer-reviewed.

6.4 — Content Deletion

You may delete any observation record or photo at any time. Deleted content is removed from public view within 48 hours, from production servers within 30 days, and from backup archives within 90 days.

VII
Community Standards & Conduct
7.1 — The Zetta Community

Zetta's community features bring together naturalists, insect enthusiasts, and curious observers from around the world. We ask all members to engage with accuracy, intellectual generosity, and respect. Constructive identification suggestions and ecological discussions are welcome; harassment, misinformation, and prohibited content are not.

7.2 — Accurate Observation Sharing

When sharing observations publicly, you agree to submit only genuine field observations and accurate descriptions to the best of your knowledge. Deliberately fabricating observations, submitting stock photos as personal field records, or misidentifying species to deceive the community violates these Terms.

7.3 — No Harassment

You may not use Zetta to harass, bully, threaten, or target any individual. Violations result in immediate enforcement action and may be reported to law enforcement.

7.4 — No Hate Speech

Content promoting hatred or discrimination against individuals or groups based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic is strictly prohibited.

7.5 — No Harmful Wildlife Content
Content that promotes, depicts, or facilitates illegal collection, trafficking, or cruelty to insects or other animals is prohibited and will be removed. Zetta supports ethical observation practices that do not harm the specimens being documented.
VIII
Child Safety & CSAE Policy
8.1 — Age Restriction

Zetta is exclusively for users 18 years of age or older. We implement date-of-birth verification at registration and apply detection measures to accounts suspected of being operated by minors. Confirmed underage accounts are immediately and permanently terminated with all associated data deleted.

8.2 — Parental Notification

If you are a parent or guardian and believe a minor has created a Zetta account, contact us immediately at service@zettas.net. We will investigate and, where confirmed, permanently delete the account and all associated data without delay.

8.3 — Child Sexual Abuse and Exploitation (CSAE)
Zero tolerance — absolute and without exception. Zetta enforces an unconditional zero-tolerance policy toward any content, conduct, or activity that constitutes, facilitates, promotes, or glorifies Child Sexual Abuse and Exploitation (CSAE) in any form. Prohibited conduct includes without limitation: child sexual abuse material (CSAM); grooming, solicitation, or exploitation of individuals under 18; and any content depicting, targeting, or endangering persons under 18.

We deploy automated CSAM hash-matching on all uploaded media, AI-assisted content analysis on community posts, and dedicated human safety reviewers. Upon confirmed detection or credible report: all associated content is immediately and permanently removed; the responsible account is permanently terminated and all associated identifiers are blocked; a mandatory report is filed with the NCMEC CyberTipline or the legally required equivalent national authority; and we cooperate fully with all resulting law enforcement investigations. CSAE-related terminations carry no right of appeal.

To report: use the in-app Report function on any content or user profile, or email service@zettas.net immediately with subject "CSAE Report." These are our highest-priority safety matter, actioned without delay.
IX
Intellectual Property
9.1 — Zetta's Property

All rights, title, and interest in the Service — including the Zetta name, logo, application design, interface, software, and all original content created by Zetta — are owned by or licensed to Zetta and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use Zetta's trademarks or proprietary marks without prior written consent.

9.2 — Your Observation Content

You retain full ownership of all original field notes, species descriptions, growth logs, and photographs you create and submit to Zetta. Zetta does not claim ownership of your personal field journal content.

9.3 — Feedback

If you submit ideas, suggestions, or feedback about the Service, you agree that Zetta may use such feedback freely without obligation. You assign to Zetta all intellectual property rights in such feedback to the extent assignable under applicable law.

9.4 — Copyright Notices

If you believe content on Zetta infringes your copyright, email service@zettas.net with subject "Copyright Notice" including identification of the protected work and infringing material, your contact details, a good-faith belief statement, and a declaration of accuracy and authority.

License to Use the Service
10.1 — Limited License

Subject to your full and continued compliance with these Terms, Zetta grants you a personal, non-exclusive, non-transferable, revocable, limited license to install and use the Zetta application on devices you own or control, solely for your personal, non-commercial use to access the Service as intended.

10.2 — Restrictions

This license does not include any right to: sublicense, resell, or commercially exploit the Service; copy, modify, or create derivative works based on the Service; reverse engineer or disassemble any part of the Service; access the Service via automated means including bots or scrapers; or circumvent any security or access control feature.

10.3 — Reservation of Rights

All rights not expressly granted are reserved by Zetta. Unauthorized use terminates your license and may expose you to legal liability.

In-App Purchases
11.1 — Payment Processing

All in-app purchases are processed exclusively through Apple App Store or Google Play. Zetta does not store your payment card details. We receive only anonymized transaction confirmation tokens and entitlement data.

11.2 — Premium Features

If Zetta offers premium features (such as expanded photo storage, unlimited observation records, or advanced export options): access is non-transferable between accounts; non-refundable except as required by applicable law or app store policy; and may be discontinued with reasonable advance notice, in which case we will make commercially reasonable efforts to provide equivalent alternative value or a proportional credit.

11.3 — Subscriptions

Subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before renewal via App Store or Google Play account settings.

11.4 — No Refund Obligations

Except as required by applicable law or app store policies, all digital content sales and premium feature purchases are final. Refund requests must be directed to the relevant app store platform.

Third-Party Services
12.1 — Mapping Services

Where Zetta displays observation locations on maps, third-party mapping services process location data to render map tiles. These providers are governed by their own privacy policies.

12.2 — External Links

The Service may contain links to external resources such as entomological databases or species reference sites. Zetta is not responsible for the content, accuracy, or privacy practices of any third-party site.

12.3 — App Store Platform Terms

Use of Zetta from the Apple App Store is additionally subject to Apple's App Store Terms. From Google Play, additionally subject to Google Play's Terms. In any conflict, the applicable platform's terms prevail for platform-specific matters.

Scientific Disclaimer
13.1 — Personal Field Journal, Not a Scientific Database

Zetta is a personal documentation and journaling tool, not a peer-reviewed scientific database. All observation records, species identifications, and ecological information on Zetta represent the personal, unverified observations of individual users.

Important: Species identifications shared in the Zetta community have not been scientifically reviewed or validated by Zetta or any scientific institution. Always consult authoritative entomological references and qualified experts before relying on community identifications for scientific, conservation, or regulatory purposes.
13.2 — No Liability for Identification Errors

Zetta is not responsible for any consequences arising from incorrect species identification in user observation records, including misidentification of protected, invasive, or dangerous species. You are solely responsible for independently verifying identifications with qualified professionals where this matters.

13.3 — Ethical Observation

Zetta supports and encourages ethical insect observation practices that do not harm specimens or disturb ecosystems. We encourage users to familiarize themselves with applicable wildlife protection laws in their jurisdiction before collecting, handling, or disturbing insects, particularly protected or endangered species.

Prohibited Activities
14.1 — Platform Integrity

In connection with your use of the Service, you agree not to:

  • Submit fabricated, plagiarized, or stock-photo observation records as personal field documentation
  • Deliberately misidentify species in public observations with intent to deceive the community
  • Publish content that promotes, facilitates, or depicts illegal collection, trafficking, or cruelty to insects or other wildlife
  • Impersonate any person, scientific institution, or Zetta representative
  • Access or attempt to access systems or data you are not authorized to access
  • Reverse engineer or tamper with the Service or its underlying technology
  • Use automated tools, bots, or scrapers to interact with the Service without written authorization
  • Harvest user data, observation records, or contact information without authorization
  • Use the Service in violation of any applicable wildlife protection law, environmental regulation, or other applicable law
  • Engage in any activity that disrupts or damages the Service or its infrastructure
14.2 — Commercial Exploitation

You may not use the Service to develop competing products, systematically extract Zetta content or community observation data, or conduct commercial activities beyond those expressly permitted by these Terms. Scientific researchers or institutions wishing to access aggregated Zetta observation data for research purposes should contact us at service@zettas.net to discuss appropriate arrangements.

Disclaimers & Limitation of Liability
15.1 — As-Is Basis

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ZETTA DISCLAIMS ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

15.2 — No Warranty on Scientific Content

ZETTA DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR SCIENTIFIC VALIDITY OF ANY SPECIES IDENTIFICATION, OBSERVATION DATA, OR ECOLOGICAL INFORMATION SHARED BY USERS ON THE PLATFORM. YOU RELY ON COMMUNITY OBSERVATION CONTENT AT YOUR OWN RISK.

15.3 — No Warranty on Data Preservation

ZETTA MAKES REASONABLE EFFORTS TO PRESERVE YOUR OBSERVATION DATA BUT DOES NOT GUARANTEE THAT DATA WILL NEVER BE LOST DUE TO TECHNICAL FAILURES. WE STRONGLY RECOMMEND REGULAR DATA EXPORTS AS A BACKUP PRACTICE.

15.4 — Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ZETTA OR ANY OF ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING LOSS OF OBSERVATION DATA, LOSS OF PROFITS, OR HARM ARISING FROM RELIANCE ON COMMUNITY SPECIES IDENTIFICATIONS, EVEN IF ZETTA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

15.5 — Aggregate Liability Cap

Zetta's total cumulative liability to you for all claims arising from these Terms or the Service shall not exceed the greater of: (a) the total amount you paid directly to Zetta (excluding amounts paid to Apple or Google) in the twelve months preceding the claim; or (b) USD $50. Where applicable law does not permit certain caps, Zetta's liability is limited to the maximum extent permitted.

XVI
Termination & Suspension
16.1 — Your Right to Terminate

You may delete your account at any time via Settings > Account > Delete Account or by emailing service@zettas.net. We encourage you to export your journal data before deletion. Termination does not entitle you to a refund of premium feature fees, except as required by applicable law.

16.2 — Our Right to Terminate or Suspend

We may suspend or permanently terminate your access at any time, with or without prior notice, if we determine you have violated these Terms, engaged in unlawful activity, or pose a risk to the safety or integrity of the platform or its users.

16.3 — Effect of Termination

Upon termination, your access ceases immediately. Public observation records may remain visible unless you request deletion before termination. Provisions that by nature survive termination continue to apply, including Sections 6.2, 9, 14, 15, 19, and 17.

Dispute Resolution & Arbitration
17.1 — Informal Resolution First

Before initiating formal proceedings, contact us at service@zettas.net describing the dispute and the relief sought. We will respond in good faith within 30 days. If not resolved within 60 days, either party may proceed to formal dispute resolution.

17.2 — Binding Individual Arbitration

Except for small claims court matters and except where prohibited by applicable law, all disputes arising from these Terms or the Service shall be resolved by binding individual arbitration administered by a recognized arbitral institution in the jurisdiction of Zetta's principal place of business. The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction.

17.3 — Class Action Waiver

YOU AND ZETTA EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. All claims must be brought individually. If this waiver is found unenforceable for any claim, the arbitration provision in Section 17.2 shall not apply to that claim.

17.4 — Jurisdictional Exceptions

For users in jurisdictions where mandatory arbitration or class action waivers are unenforceable (including EU member states and the United Kingdom), these provisions shall not apply to the extent prohibited. Such users retain the right to bring disputes before courts of competent jurisdiction in their country of residence.

Content Moderation & Enforcement
18.1 — Moderation Rights

Zetta reserves the right, but not the obligation, to review, moderate, remove, or take action on any content or user behavior at any time, in its sole discretion, without prior notice. Moderation uses automated screening and human review guided by these Terms and our Community Guidelines.

18.2 — User Reporting

You may report any content or user that appears to violate these Terms using the in-app Report function. Reports are reviewed by our moderation team. Submitting false or malicious reports is a Terms violation and may result in enforcement action against the reporting account.

18.3 — Enforcement Actions

Violations may result in: a warning; content removal; temporary account feature restrictions; temporary account suspension; or permanent account termination. Severity is calibrated to the nature and seriousness of the violation. For CSAE violations or severe illegal conduct, immediate permanent termination and law enforcement referral occur without warning or appeal.

18.4 — Appeals

For enforcement actions not involving CSAE or illegal content, email service@zettas.net with subject "Enforcement Appeal" providing relevant details. We review appeals in good faith. CSAE-related terminations carry no right of appeal.

Indemnification
19.1 — Your Obligations

You agree to indemnify, defend, and hold harmless Zetta and its affiliates, officers, directors, employees, contractors, and agents from and against all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your content; (c) your breach of these Terms; (d) your violation of applicable law; (e) your infringement of any third-party right; or (f) any harm caused by inaccurate or misleading observation data you publish that other users rely upon.

19.2 — Control Rights

Zetta reserves the right to assume exclusive control of any matter subject to your indemnification. You agree to cooperate fully and may not settle any claim imposing obligations on Zetta without our prior written consent.

Governing Law
20.1 — Applicable Law

These Terms are governed by the laws of the jurisdiction in which Zetta is incorporated, without regard to conflict of laws principles, except where mandatory consumer protection or data protection laws in your country of residence impose higher standards that cannot be contracted out of.

20.2 — Consumer Rights

If you are a consumer in a jurisdiction with mandatory consumer protection legislation, your statutory rights are not limited by these Terms. In any conflict, your statutory rights prevail to the extent of the conflict.

XXI
Changes to the Service & Terms
21.1 — Service Changes

We may add, modify, or discontinue features at any time. We will provide reasonable advance notice of material changes where practicable, particularly for changes affecting photo storage limits, data export formats, or community feature availability.

21.2 — Terms Updates

Material changes are communicated at least 14 days before taking effect via in-app notice, push notification, and/or email. Non-material clarifications may be updated without advance notice.

21.3 — Acceptance

Continued use of Zetta after any revised Terms' effective date constitutes acceptance. If you do not accept, stop using the Service and delete your account before the changes take effect.

XXII
Miscellaneous
22.1 — Entire Agreement

These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Zetta regarding the Service.

22.2 — Severability

If any provision is found invalid or unenforceable, it shall be modified minimally to make it enforceable, or severed if modification is not possible. All remaining provisions continue in full effect.

22.3 — Waiver

Our failure to enforce any right or provision is not a waiver. Any waiver must be in writing and signed by an authorized Zetta representative.

22.4 — Assignment

You may not assign these Terms without our prior written consent. Zetta may assign them in connection with a merger, acquisition, or asset sale, with notice to affected users.

22.5 — Force Majeure

Zetta is not liable for delays or failures in performance resulting from events beyond our reasonable control, including natural disasters, government actions, infrastructure failures, cyberattacks, or pandemics.
